PRIVACY

JIVE HR is committed to protecting the privacy of the users of the Website (the “User”). JIVE HR does not solicit or collect personal data from anyone under the age of 18.  Users under 18 years of age should not use this website or JIVE HR’s services nor enter information on this Website.

These Privacy clauses inform the User about our online collection and use of data via the Website our via an email that you send us. JIVE HR is the controller of the processing of these data.

(1)  PROCESSING OF PERSONAL DATA

When visiting the Website, certain kinds of information, such as the website that referred the User to us, the User’s IP address, browser type and language, and access times, may be collected automatically as part of the site’s operation. JIVE HR may also collect navigational information, including information about the pages the User views, the links he clicks and other actions taken in connection with the Website. Upon login, JIVE HR may match the User’s visit and navigational information with personal information that has been voluntarily provided to JIVE HR.

Personal information (e.g., name, mailing address, email address) is collected when the User completes the contact form or when the User sends his/ her personal data to us via email (e.g. a resume).

JIVE HR collects and uses its Users’ personal information:

• for recruitment purposes if the User applies for a freelance opportunity with us, 

• to operate and improve the Website, 

• to provide customer service, 

• to perform research and analysis aimed at improving our services and technologies,

• to display content that is customized to the User’s interests and preferences,

• to fulfil our legal, regulatory and risk management obligations,

• to manage and administer our relationship with the User and our clients,

• to communicate with the User.

If JIVE HR receives the User’s electronic contact details through the Website’s Contact form or through an email sent by the User, JIVE HR may also send surveys or marketing communications to inform the User of new services or other information that may be of interest. If the User does not wish to receive marketing communications, he/she can apply the “unsubscribe” instructions included within each email communication.

 (2)  SECURITY OF PERSONAL DATA

The security of Users’ personal data is important to JIVE HR. JIVE HR follows generally accepted industry standards to help protect personal data. 

When JIVE HR engages a third party service provider to collect or otherwise process personal information on our behalf, the third party is selected carefully and will be required to have appropriate security measures in place.

If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any personal information you might have sent to us has been compromised), please immediately notify us by sending an email to info@jive-hr.be.

(3)  COMMUNICATIONS WE MAY SEND 

From time to time, we will send you information about JIVE HR, including newsletters, invitations to events and opportunities. If you do not wish to receive this information, or if you are already receiving this information from us or third parties acting on our behalf and you no longer wish to do so, please email us at info@jive-hr.be.

To improve and ensure the relevance of the communications we send, we collect information about whether you read the emails and other materials that we send to you, click on the links in those emails and materials, and whether and how you visit our website after you click on those links.  We do this by using software that places a cookie on your device which tracks this activity and records it against your email address.  Please see the section entitled ‘Use of cookies and other technologies’ for more information on cookies.

(4)  USER’S RIGHTS

The European Union’s General Data Protection Regulation and other applicable data protection laws provide certain rights for data subjects.

Users are entitled to request a copy of the information we hold about them and information about how we process it.  Users may also have a right in accordance with applicable data protection law to have it rectified or deleted, to restrict or suspend our processing of that information, to object to our processing of your information and, in some circumstances, to request receipt or transmission to another organization, in a machine-readable form, personal information relating to the User that the User has provided to us. Where we rely on the User’s consent to process their personal information, the User has the right to withdraw their consent at any time. The User also has the right to lodge a complaint in relation to JIVE HR’s processing of their personal information with a local supervisory authority.

If the User objects to the processing of their personal information, or if the User has provided their consent to processing and the User later chooses to withdraw it, JIVE HR will respect that choice in accordance with its legal obligations.

The User’s objection (or withdrawal of any previously given consent) could mean that JIVE HR is unable to perform the actions necessary to achieve the purposes set out above or that the User may not be able to make use of the JIVE HR website or member benefits.  Please note that even after the User has chosen to withdraw their consent we may be able to continue to process the User’s personal information to the extent required or otherwise permitted by law, in particular in connection with exercising and defending our legal rights or meeting our legal and regulatory obligations.

JIVE HR must ensure that your personal information is accurate and up to date. Therefore, please advise us of any changes to your information by emailing us at info@jive-hr.be.  

(5)  HOW LONG WE KEEP THE USER’S PERSONAL DATA

Your personal information will be retained in accordance with our general data retention policy which categorizes all of the information held by JIVE HR and specifies the appropriate retention period for each category of data.  Those periods are based on the requirements of applicable data protection laws and the purpose for which the information is collected and used, taking into account legal and regulatory requirements to retain the information for a minimum period, limitation periods for taking legal action, good practice and JIVE HR’s business purposes.

(6)  WHO WE SHARE PERSONAL DATA WITH

Except as disclosed in this Policy or if legally required, JIVE HR does not divulge or share personal information of its Users with third parties.

JIVE HR may however share personal information within its corporate group, including subsidiaries and divisions, all of whom may use Users’ information for the purposes disclosed herein. 

JIVE HR may also share personal data with certain trusted third parties in accordance with contractual arrangements in place with them, including its contractors, professional advisers, IT, agents or service providers for the purposes set forth in this policy. These companies will only be permitted to obtain the personal information they need to provide the service. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose and from disclosing this information to other parties. 

If personal data are transferred to countries outside the European Union that do not provide an adequate level of data protection, JIVE HR will take sufficient contractual safeguards for the protection of the data.

Where necessary, or for the reasons set out in this policy, personal information may also be shared with regulatory authorities, courts, tribunals, government agencies and law enforcement agencies.  While it is unlikely, we may be required to disclose your information to comply with legal or regulatory requirements. We will use reasonable endeavors to notify you before we do this, unless we are legally restricted from doing so.

JIVE HR may use social media sites such as Facebook, LinkedIn and Twitter.  If you use these services, you should review their Privacy Policies for more information on how they deal with your personal information.

(7)  USE OF COOKIES AND OTHER TECHNOLOGIES

JIVE HR may collect non-personally identifiable data, by using “cookies” and “action tags”.

"Cookies" are small text files that are placed on the User’s computer in order to identify the User’s browser and the activities of his computer on the Website. JIVE HR may use Cookies to allow us to statistically monitor how the User is using the Website to help us improve our online offerings, or to determine the popularity of certain content. You may configure your web browser to issue a warning every time a cookie is installed, or for it to block the installation of cookies. Please be aware that if you decline the use of Cookies, you will be unable to use some of the sections of the Website.

“Action tags”, also known as web beacons or gif tags, are a web technology used to help track website usage information, such as how many times a specific page has been viewed. Action tags are invisible to Users, and any portion of the Website, including advertisements, or email sent on JIVE HR’s behalf, may contain action tags. JIVE HR may select and use from time to time different third parties to track website usage through action tags on the Website.
